Shared Parental Leave and Pay (ShPL)
On the 29 November 2013 the government published its response to the consultation on the administration of Shared Parental Leave and Pay (ShPL), which is due to come into force in April 2015. We wanted to follow on from our recent blog posted at the end of May regarding the Governments crack down to stamp out illegal workers within the UK. In May we saw the introduction of the new penalty scheme, with the main focus on employers and recruiters, pushing the point that it is their duty to ensure that all employees hold the right to work within the UK. The Guardian Reports- HMRC gets tax wrong for 5.5 million people. "Millions of workers face having to give money back to the government after inadvertently paying the wrong amount of tax. Mistakes by HM Revenue and Customs (HMRC) left an estimated 5.5 million underpaying or overpaying their tax through the pay as you earn system (PAYE) in 2013-14, according to the Daily Telegraph. Rogue Employers – Will face penalties of up to £20,000 if they do not pay their workers National Minimum Wage due to a Government crackdown.
The Government have decided to increase the penalties issued to rogue employers who are not following the law and paying their workers below National Minimum Wage. These employers will now be issued with a fine up to £20,000 per underpaid worker in a Government crackdown. At present employers who are caught paying their employees less than National Minimum Wage, have to pay back the unpaid wages to the worker as well as a calculated penalty based on 50% of the underpayment.
