The following is a copy of an email sent to Recruitment Agencies that are working within the Supply Teacher Framework explaining that they are to confirm that they are not using Joint Employment models to pay their Supply Teachers.
Yet more proof that the government and governing bodies are clamping down on services that they deem unsuitable for workers to be paid under.
“We have recently been made aware of an emerging ‘joint employment model’ whereby the employment business and an umbrella company have entered into a ‘partnership’ type of arrangement where they jointly employ and supply the temporary worker.
In this instance the temporary worker receives a contract of employment which states that they are employed by the ‘joint employer’ which is the employment business and the umbrella company.
The CCS Supply Teachers framework states suppliers shall payroll workers as a PAYE worker via their own payroll, be paid by an umbrella company or as a limited company contractor inside IR35. Therefore, this joint employer model falls outside the scope of delivery for workers supplied through the framework.
For the avoidance of doubt, no workers provided through the framework should be employed by you or a partnership arrangement in this way. If any workers are currently in a post through the framework their status should be amended immediately.
In addition, CCS are in dialogue with colleagues at Employment Agency Standards Inspectorate (EAS) as they are reviewing the Conduct Regs in relation to this employment model. Once we have further information we will share this.
Action Required
Please acknowledge receipt of this message, and respond to confirm that you have no workers employed through the framework using this arrangement.
