Speaking to Contractor UK, Lisa Keeble of All Umbrella Companies Are Equal (AUCAE), spoke about the ongoing discussions surrounding Travel & Subsistence for contractors and the plans HMRC have to revoke this tax relief, suspected to come into play next April.
HMRC have confirmed that any workers, that find placements through recruitment agencies, are to be considered as working under ’Supervision, Direction or Control’ (SDC), preventing them to claim tax relief on travel and subsistence, due to the SDC Consultation by HM Revenue & Customs.
If Section 44 (2) of the SDC consultation, remains in place at the point any new regulations are actioned and the Revenue decide to apply the SDC test on the IR35, then any contractor working through a recruitment agency will fit within IR35.
With this update many major contractor trade bodies are becoming concerned with deadline at the end of September.
